Abstract:
Problem. The causes of the preparation of the article are the difficulties in the process of punishment appointment for the crime, committed in complicity, which were exposed in the result of the analysis of the Criminal Code of Russia and law enforcement. Model. The study was performed with the formally juridical and relatively legal methods, with the functional and statistical approaches and analysis and synthesis methods. Conclusion. Analyses of The Criminal Code of Russia and of the scientific literature shows a high public danger of group forms of complicity, what implies more severe punishment for people committed such crimes compared with the people committed crime individually. The author offers to supplement some elements of crimes by qualifying features «group», «group with preliminary agreement», «organized group». Practical importance. The author offers to optimize and improve Criminal Code of Russia by means of supplement some elements of crimes by qualifying features. Value. Conclusions and proposals of the article can be used in the legislative work, in the preparation of the guideline interpretations of The Supreme Court of Russia and in the scientific and study process.
