On some issues of compliance with Art. 2052 of the Criminal Code provisions of Council of Europe Convention on the Prevention of Terrorism

In the present article raises issues of harmonization of Russian criminal legislation in accordance with ratified international legal instruments. The participation of the Russian Federation in various international treaties, conventions and so on. Implies mandatory reduction of domestic law in conformity with the international, which in some cases is a formidable task. The author investigates one such case, namely, matching 2 of Article 205 of the Criminal Code provisions of the Council of Europe Convention on the Prevention of Terrorism. This issue has repeatedly been raised by some researchers, but consensus on it has not yet been reached. Research author conducted in the presented paper are designed to develop optimal solutions to this problem. The methodology used by the author is based on the use of complex and chastnonauchnogo general scientific methods. Along with the knowledge of the dialectical method used by formal-logical method, critical analysis, formal-legal method of comparative legal method. The author examines the Russian law on the participation in the international treaties of the Russian Federation, discusses the terminology used by the criminal legislation of the Russian Federation and the rules of the Convention on the Prevention of Terrorism, leads the point of view of some scientists, from whence a number of joins. The result of the study becomes a conclusion is sufficient under the disposition of Article 205 2 of the Criminal Code provisions of the Council of Europe Convention on the Prevention of Terrorism. Studies conducted by the author of the present article, demonstrate a clear, coherent logic of copyright judgments an original approach which can be taken into service by other authors in similar legal studies. As for the final opinion of the author is very possible further discussion, involving a wide range of researchers in the field of criminal and international law, counter-terrorism policy.
