EUROPEAN VALUES & NATIONAL LAW: THE PROBLEM OF LEGAL ENFORCEMENT

The main task of this article is find out how effective is employment of methods intended to enforce of European values related to legal, political and social differences essentially among the states of New and Old Europe and EU institutions. The task of the article was fulfilled by research of case law of Court of Justice, EU law & national law research and based on EU related law scientific outputs. There is low-level effectiveness of enforcement rights stipulated in Article 2 TEU. With regard to effectiveness of enforcement rights stipulated in Article 2 TEU is necessary to employ other methods of EU law in force. In other words successful application of European values requires using of other legal ways to identify specific violations of Article 2 TEU. Institutions of EU and subjects which work with EU law on daily base should be aware of fact that the protection of European values should be based on alternative instruments stipulated in EU law.
