Abstract:
The following case study touches upon contract of carriage legal standards application. The main contract violations made by carriers as well as passengers are under discussion. The article passes an opinion on the current legal gaps in passenger rights protection. The reasons for such an analysis are the author's wide experience in the field of representing passengers and carriers' rights and a desire to promote changes of the existing negative practice in provision of transportation services to customers. Carriage legislation practice is the realm of the research with particular emphasis on the passengers and baggage carriage resulting in a thoughtful analysis of emerging practical problems in law enforcement. The article might provide the basis for more detailed study of the topic and further legislation improvement, research and application of current carriage legal standards. It would interest experts in carriage contractual relationship, civil law scholars as well as non-specialist audiences.
