Abstract:
The article examines the institution of active repentance as one of the discretionary grounds of active repentance. Apart from the theoretical basis given in the article, the author analyzes controversial court cases which apply art. 75 of the Penal Code and art. 28 of the Criminal Procedure Code of the Russian Federation and explains the alteration expediency of the Supreme Court's plenary draft decision discussed in 2016.
