MATERIAL LIABILITY OF AN EMPLOYER FOR INTRODUCTION OF INCORRECT FORMULATION OF DISMISSAL REASONS OF AN EMPLOYEE INTO EMPLOYMENT RECORD BOOK

The necessity of the present research of an employer liability for introduction of wrong or not corresponding information to the legislation of the formulation of the reasons of dismissal of an employee in employment record book which was caused by the necessity of studying the effectiveness of protecting the rights of employees provided by this kind of an employer liability. The relations on material liability of an employer occurring in the connection with the illegal deprivation of an employer of possibility to work are the object of the research. The problems which are connected with notion of material liability of an employer for introduction of wrongful date on ceasing of a labor agreement, modern condition and further development of norms of LC of RF directed to the regulation of this liability are the subject of the research. The author analyzes the used terms “employment record book”, “wrongful” and “not corresponding” in the paragraph 4 of the Article 234 of LC of RF consisting of the legal basis of construction of this norm which in aggregate have material liability of an employer that showed the bulking of the present paragraph and excessive use of the word “wrongful” in it. Particular attention is paid to the consideration of the available position of labor law in science, according to which the person wishing to go to work, may not submit the employment record book to the employer. The methodological basis of the research made up: general scientific dialectical method, universal scientific methods (systemic-structural, functional, method of analysis and synthesis, induction and deduction), as well as the specific scientific methods (comparative-legal, formal-logical). The novelty of the subject area of the article is in consideration of material liability of an employer for introduction of incorrect data into an employment record book, which is connected with a ceasing of labor agreement which has never been studied before. The special contribution into study of such employer’s material liability is an offer of the author on reconstruction of the article 234 of LC of RF by means of assignment of an employer’s liability in a new paragraph that will increase the effectiveness of the legal mechanism of the protection of labor rights of employees.
