Abstract:
The authors reveal the concept of money based on the analysis of the judicial decisions, and through their features compare regular currencies with the cryptocurrencies. The analysis shows that Bitcoin has not only all the functions of money (funds, capital, means of payment, unit of account, world money), but also it is a money transmitter, which gives the right to recognize Bitcoin as a currency and a money transmitter at the same time. Further, the influence of the dispute resolution within WTO on the ratio of price imported and exported indices on world trade as a whole is examined. This is another indicator that bitcoin can be both a matter of dispute in the WTO and a measure of the cost of the same subject. These gaps have not yet been resolved, but at the present time, principally new types of international courts are being developed - decentralized courts capable to solving this problem partially. The authors come to the conclusion that the world is on the verge of dramatic changes in the structure of international justice in view of new needs based on the nature of bitcoin and the blockchain technology.
