The article examines the formation of a modern system of the execution of criminal sentences in the form of imprisonment in the Federative Republic of Brazil. A high number of people held in detention centers is a distinguishing feature of the Brazilian penal system among other countries of South America . This problem becomes an indicator of the specific features of the national criminal and criminal-executive policies as well as a factor causing difficulties in ensuring the rights and legitimate interests of persons serving a sentence of deprivation of liberty or those held in pre-trial detention centres.
