Abstract:
The task of the study is to identify legal gaps that regulate the procedure of forced labor execution. To achieve it was carried out the analysis of the legal nature of criminal punishment in the form of forced labor, its place in the system of criminally legal sanctions as well as the correspondence of legal requirements presented in various normative legal acts regulating the authorities of the penitentiary system staff. The social relations arising over the execution of forced labor were the object of the study. At the same time the problems of ensuring of security and the prevention of committing crimes by convicts and other offenses during the period of forced labor serving made the subject of the scientific research. The results of the study indicate a legal gap in the regulation of the peculiarities of the usage of physical force, special means and firearms by officials executing forced labor. The introduction of relevant amendments to the law of 21.07.1993 №. 5473-1 «On the institutions and bodies executing sentence in the form of deprivation of liberty» will enable the correctional centre's employees by the right to use physical force, special means and firearms to suppress crimes and other offences committing by convicts during the period of forced labor serving.
