LEGAL REGULATION OF PASSPORT AND REGISTRATION SERVICE: PROBLEMS AND PROSPECTS

In this article, the author examines the legal principles governing passport and registration service. He analyses current Federal laws as well as the by-laws enacted in accordance with the aforementioned laws. The relevance of this article is to present legislative regulation of passport and registration accounting of citizens of the Russian Federation is carried out by means of several normative-legal acts, which leads to difficulties in the application of rules of law, including the erroneous interpretation or improper application of the rules as ordinary citizens and law-appliers, including courts and law enforcement bodies. The lack of a unified and systematic approach to regulation and fragmentation in the application of legal norms by different authorities to define the scope set in this study problems. The author analyzes the legislation and discusses the opinions and views of the scientific community, law enforcement practice, including judicial. He concludes that a number of provisions require improvement due to the lack of the necessary efficacy and contribution to the achievement of their objectives. The conclusion about the presence of a number of provisions that require improvement, as it does not have the necessary efficiency and do not contribute to the achievement of its objectives. The analysis of legal regulations and their identified problems resulted in the proposal to modernise the current legislation, such as the proposal to ensure unity of purpose and actual implementation of the Institute of registration of citizens, as well as ensuring a unified approach in the implementation of the norms on the subject of the present study, all government bodies. The findings present in this article, can be take into account by legislators when developing new regulations, agencies directly involved in a public function in the passport and registration issues, as well as used for further scientific study and research of assigned problems.
