Abstract:
The Russian Federation takes a leading place in the world in the field of international cooperation on uses of atomic energy for peaceful purposes. However, the lessons of Chernobyl and Fukushima is not allowed to forget that for all its advantages, nuclear power is fraught with accidents with serious, sometimes catastrophic consequences for life, health and the environment, and therefore brings to the fore the problem of radiation safety and nuclear damage compensation. The objective of this article is to consider how the issues of compensation for nuclear damage shall be regulated in international agreements of the Russian Federation involving the use of nuclear energy. To solve this problem, these international agreements of the Russian Federation were classified into two groups: the first group includes framework intergovernmental agreements, defining the basic principles of cooperation in the field of use of atomic energy (agreements on cooperation in the field of use of atomic energy for peaceful purposes). The second group got agreements governing certain aspects of cooperation in the field of use of atomic energy: agreements on cooperation in the design, construction and operation of nuclear power plants; agreements in the field of transport of nuclear material; the agreements on the disposal of nuclear materials and spent nuclear fuel. The analysis showed that the issue of liability for nuclear damage in bilateral agreements of the Russian Federation does not always receive due attention. Ratification by Russian Federation in 2005 the Vienna Convention on civil liability for nuclear damage of 1963, rules of which are detailed enough, had sold some problems of this issue. However, in relations with States not party to the Vienna Convention, the utmost attention regulation on liability for nuclear damage should be given, among others by reference to the 1963 Vienna Convention, as it done in the agreements with Vietnam. It is also feasible to consider the participation of the Russian Federation in the 1997 Protocol amending the Vienna Convention on civil liability for nuclear damage and in the 1997 Convention on supplementary compensation for nuclear damage. Finally, adoption of the Federal law on civil liability for causing nuclear damage and its financial security is long overdue necessity.
