Abstract:
The Barents Sea, located between Norway and Russia is one of the most promising places for the development of production of hydrocarbon resources, so necessary for the Russian economy. The presence of huge oil and gas reserves attracted the attention of major oil companies and is also the cause of territorial disputes, disputes the ownership of shelf areas in the Barents Sea. Today, however, to the fore, according to the author submitted articles, goes global problem of pollution of the Arctic as a result of the intensification of production of hydrocarbons. The solution to this problem, the author sees in the creation of the missing to date of the international legal instruments that make up the legal regime of the Arctic. The author's purpose in this article is the rationale for the proposals for the development of the legal regime of the Arctic. The methods of induction, analysis and synthesis, systematic and structural, statistical, legal and comparative methods. In this paper we study the current state of exploration and production of oil and gas in the Arctic, the natural environment of the Barents Sea, as well as current and possible consequences of the intensification of oil and gas ekolognicheskie. A brief analysis of the numerous bilateral and multilateral international legal acts regulating the border areas, the production of oil and gas production and exploration activities, environmental monitoring and assessment. The author presents a number of noteworthy findings, among which should be noted that a single document or set of documents, which would establish the legal regime of the Arctic, currently does not exist. The originality of the present work is seen in the fact that the author invites the reader to his vision of the legal regime of the Arctic, in the form of an official "Treaty on Environmental Protection of the Arctic", which should get a mandatory regulatory status in the operation of the Arctic as a whole. The idea of creating such a document seems worthy of further discussion in the scientific community with the participation of experts in various areas − oil sector of the economy, ecology, and international law. The practical significance of original research and findings seen in the fact the author's ideas, being perceived by the leaders of the Arctic states, will allow rational use, preserve natural resources significantly reduce the damage caused by the activities of exploration and production of hydrocarbons to the environment.
