Application lex constructionis for the regulation of international construction contracts in Russia

Aims and objectives: The lack of universal international treaty regulating international construction contracts offset by lex constructionis (sample contracts, legal guides). The most widely used in the international practice got FIDIC standard contracts, the use of which in Russia requires adaptation to national law. The aim of the article is to analyze the application of lex constructionis in Russia for the regulation of international construction contracts. To achieve this goal in the following tasks: to explore the historical development of model contracts; give a general description of model contracts; compare the provisions of standard contracts and Russian law; determine the conditions of application of the model contracts in Russia; identify the legal nature of the model contracts. Studies of model contracts are contained in research of Glover J., Hughes S., Hök G.S., Jaeger A.V., Molineaux C. Subject and object of study: The subject of study is an international investment and building relationships. The object of research is the legal regulation of the international construction contract. Conclusions: Lex constructionis − the main source of regulation of the construction contract in private international law. The most widely used in the international practice got FIDIC standard contracts which are intended for international construction projects, but can also be used in national projects. In applying the model contracts may need to be adapted under the mandatory rules of national law. Comparative analysis of model contracts and Russian law shows that they have different positions on some issues, but, nevertheless, many of the provisions do not conflict with each other.
