Abstract:
Objective: the main task of the article is to consider specific issues related to acquisition and termination of the procedural status of the participants of the proceedings on the example of the legal deficiencies relating to the status of lawyers, juries and people mistakenly recognized victims. Research area: public relations in the acquisition and cessation of the status of the participants of criminal proceedings related to granting the subjects of individual rights and responsibilities. Conclusions: current criminal procedure law, fully and comprehensively regulating the procedural status of the main participants in criminal proceedings, however, contains some gaps concerning the moments of acquisition and termination of procedural status. A significant part of gaps in this issue take up the outstanding moments procedural status of jurors, lawyers and people mistakenly recognized victims in the criminal case. The most effective way to address such gaps, it seems, is to amend the current legislation. However, to make the corresponding changes overcoming these gaps is possible by reference to the analogy of law.
