ILLICIT TRAFFICKING OF POISONOUS SUBSTANCES FOR THE PURPOSE OF MARKETING (ARTICLE 234 OF THE CRIMINAL CODE)

The article considers issues arising in the theory and practice of application of criminal law in the area of illicit trafficking of poisonous substances. Objective: the authors analyze art. 234 of the Criminal Code "Illegal turnover of strong or poisonous substances for the purpose of sale" on the basis of criminal law, scientific literature, judicial practice, as well as to find solutions to existing problems. Model: methodological basis of this study is a set of methods of scientific cognition, among which the leading role is the dialectical method. This article uses scientific (dialectics, analysis and synthesis, abstraction and concretization) and astronaute (formally legal, comparative legal, technical and legal) research methods. In the course of scientific research special attention was paid to the comparative, systematic research methods. Results: the Authors insist on the mandatory adoption of the Resolution of Plenum of the Supreme Court of the Russian Federation. Practical significance: conclusions and suggestions can be used in legislative activities on the improvement of the criminal law, with further research in the topic. Conclusions: it is necessary to adopt a Resolution of the Plenum of the Supreme Court of the Russian Federation, which would clarify the issues of qualification of crimes related to illegal trafficking of poisonous substances for the purpose of marketing. The adoption of this resolution will significantly improve the effectiveness of criminal law in practice in the field of illicit trafficking of poisonous substances for the purpose of marketing. Originality/value: it will allow to solve the problems that arise when qualifying offenses under art. 234 of the Criminal Code; the use of recommendations for changes to the criminal law.
