Abstract:

The article is dedicated to the differentiation between the criminal offence and non-performance (undue performance) of contract as the civil offence. The author examines social relations fall under both criminal and civil law, analyses the current case law. The article determines relevant criteria making it possible to classify a non-performance act either as a civil or as a criminal offence
