Non-cash money as object of the credit agreement

The object of the loan agreement is cash, according to the Civil Code of Russian Federation. Herewith, because of the need to ensure the safety of the receipt of the funds by the borrower, as well as optimize the resources of the bank, loans are increasingly given by crediting the loan amount to the bank account of the borrower. In this regard, the question arises about the existence of non-cash assets as a separate object of civil rights. The author analyses the existing positions in the legal literature on the above issues, according to the latest changes of the Civil Code of Russian Federation in this part. The article provides recommendations for improving the civil legislation of the Russian Federation in order to eliminate current contradictions.
