FREEDOM OF LABOR AND RIGHT TO LABOR IN THE OFFICIAL AND ALTERNATIVE DRAFTS OF THE CONSTITUTION OF THE RUSSIAN FEDERATION

Background: the inaccuracy in conveying the norms of the Constitution of the Russian Federation generates either some misunderstanding or ambiguity of such understanding. The provision of Article 37 of the Constitution of the Russian Federation can be an example of such an inaccuracy. To explain the reasons of the inaccuracy should analyze the drafts of the Constitution of the Russian Federation. The problem of understanding the contents and essence of the rights and freedoms in labor sphere is interesting for legal community not only in Russia but also in other countries (K. S. Ramankulov, Kyrgyzstan; M. T. Gabdualiev, Kazakhstan; etc.). Materials and methods: the research base of the article is compiled from normative legal sources, the drafts of the Constitution of the Russian Federation and scientific views of jurists analyzed through general and special methods of scientific cognition. Conclusions: the author analyzes the reasons for the adoption of the new Constitution of the Russian Federation and gives the over-all appreciation of the rights and freedoms in labor in the drafts of the Constitution of the Russian Federation. Originality and importance: the results of the given work can be useful for law scientists and law students in research of the constitutional rights and freedoms in labor sphere.
