Abstract:

Objective: In the legal doctrine and legislation of copyright, much attention is paid to the protection and protection of the interests of rights holders of works of science, literature and art. However, in order to improve the level of education and culture of the whole society, civil-legal means acquire the actual importance, which allow using the works by an unlimited number of persons without the permission of the rightholders. Model: To identify the characteristics of civil means of free use of works, the legal nature of the free use of works is examined, and the features of civil legal means in the theoretical aspect are analyzed. Conclusions: Specific features and types of civil means of free use of works are revealed in order to determine the possibilities of using the works of rightholders by an unlimited number of persons. Practical significance: A comprehensive idea of civil means of free use of works of science, literature and art in copyright has been formed, in addition to the development of the theory of civil and legal means, the concept of civil means of free use of works has been proposed, their features have been identified, a special approach to their classification.
