Abstract:
The Constitution of 1869 was a combination of conservative constitutional legislation of the time of Prince Michael Obrenovich and moderately liberal ideas of Jovan Ristich. According to article 1 of the Constitution of 1869 «the Principality of Serbia is a constitutional monarchy with popular representation. Part II of the Constitution contained the «system» of fundamental rights, freedoms and duties of citizens. These included: the right to liberty, inviolability of residence, freedom of speech and press, the right to a trial in a proper court. The Constitution provided for «the gradual introduction of trial by jury». A number of the traditional rights and freedoms were not provided. The Constitution of 1869 did not mention the privacy of correspondence, the freedom of movement and choice of residence, which was already provided by the Constitution of 1835. In addition, individual rights and freedoms could be restricted for «some time» that questioned their warranty. The article presents the analysis of the humanitarian aspects of the Constitution of 1869.
