Abstract:
There are considered the categories "right", "tradition", "value" in their interaction and interference. The main problem of research is connected with search of the answer to a question: how legal and other traditions in society form system of values, and what extent of influence of tradition on the right. There is characterized the specifics of the methodology based on the theory of values, the axiological method is analyzed. Some achievements of Marxist methodology of the right are analyzed and those opportunities which open at matter research by the experts adhering to postne-classical methodological paradigms are shown. The attention to standard nature of legal tradition is paid, essential lines of tradition in the right are characterized. The ratio of definitions "right" and "value" is characterized, specifics of consideration of axiological problems within national type of thinking is shown. In this context the examples characterizing the Belarusian, Russian legal practice are given.
