Abstract:
The Russian criminal law has traditionally included the rules of the declaration , defining the range of public relations, subject to the protection of the criminal law ( Part 1 of Art . 2 of the Criminal Code). The data system of social relations , first of all , represents a hierarchy of protected criminal law means values ​​, and, secondly , serves as a template construction of the Special Part of the Criminal Code of the Russian Federation. It should be stated that not all socially important values ​​are reflected in Part 1 of Art . 2 of the Criminal Code . In particular, no mention is a significant social good as cultural heritage, although the Criminal Code there is a significant group of criminal law , establishing responsibility for the attacks on the World Heritage Sites . The purpose of this paper is to bring the evidence to support the need to include in the list of protected objects of criminal law such social benefits as a cultural heritage . To achieve this goal , the following objectives: considering the relationship between the concepts "object of criminal law protection " and " the object of the crime ", studied the rules of international law and European law , which treat the concept of "cultural heritage" ; analyzed rates of domestic regulatory legislation defining the concept of "cultural heritage " ; systematic analysis of the criminal law of the Russian Federation in order to determine the species , generic and common object of crimes that infringe on the cultural heritage. Methods of investigation were : legal , formal and dogmatic , systematic, comparative , the method of comparative analysis.
