TO QUESTION ABOUT «LIVING» US CONSTITUTION

In article analyzed: evolution of North-American constitutionalism; concept and content of so-called «living» US Constitution; role and importance of activity of US Supreme Court in regulation of emerging social relations, on basis of constitutional law norms, which sources are normative law acts and judicial-court precedents. Attention is also drawn to position of «originalists» and «nonoriginalists» in relation to fact, that, in its opinion, correctly considered primary (secondary) sources of constitutional law norms - leg, other normative law act or judicial-court precedent. One of main conclusions of author is, that «living» US Constitution is set of mutually reinforcing each other and creatively interacting with each other of her text, amendments to her, other constitutional law acts and documents, as well as norms of common law, which is formed mainly on basis of judicial-court precedents, developed by judges of North-American Supreme Court to give Basic Law of country, who is difficult to formal changes, necessary flexibility, agility in process of judicial regulation of social relations.
