ON THE POLITICAL AND LEGAL IMPORTANCE OF DECLARATIONS

In the article the author considers declarations as political and legal documents. The role of declarations in the history of constitutionalism is shown. Signs of a declaration as a political document and an act having legal effect are detected. Mechanism for enforcing a declaration is determined. The relationship between declarations and other constitutional acts, first and foremost, the constitutions, is investigated. The role of declarations in the history of Russian constitutionalism is especially emphasized. An attempt is made to define the place of a declaration in the system of sources of constitutional law. The importance of these documents in other areas of law is noted. Different approaches of researchers to the problem of determining the nature of declarations are shown. As a result of research, the conclusions are made, which allow categorization of declarations according to the legal effect, legal form and others. The importance of a declaration as a politico-legal form, expressing the basic principles of the constituent authorities, is revealed.
