Abstract:
The article deals with the acute problem of the relation of the state and civil society. The views of experts on this issue were divided approximately equally. One group advocates the position that civil society is generated by the state, is part of the state, subject to the logic of public administration in the country , and therefore begin the study of institutions of civil society need to study the state of organization of state power and control of the national legal system and legislation. Another group of jurists offers differentiate civil society and political society , and civil society − is the relationship between citizens and the political − the relationship between government and citizens. Due to this distinction civil society acquires the scope of horizontal relations , separated from power and gets freedom. Authors defend the position that civil society is not a real social phenomenon, but only a theoretical construct, and how we reveal it, will depend on the practice of relations between the state and society. Without engaging in this speculative design research methodology can not realistically analyze the scientific problem of interaction between state and society.
