THEORY AND PRACTICE OF FORMATION OF CONSTITUTIONAL CONTROL BODY: EXPERIENCE OF SERBIA

The article presents an analysis of the new order of formation of the Constitutional Court of Serbia. The author explores the features of the election and the requirements for candidates for the position of the constitutional judge of Serbia on the basis of the experience of the oldest constitutional courts in Europe. At present in the formation of the Constitutional Court of Serbia, as well as Italy, are involved three branches of government that promotes the independence of this state body. In the new Constitution of the Republic of Serbia Serbian constitutional legislator redefined term of authorities of constitutional judge in the following way: Austrian (permanent) model was adopted to the Italian (nine years) model. However, unlike Italy, where constitutional judge cannot be re-elected, in Serbia Judge of the Constitutional Court can be re-elected. Examining the normative regulation of the composition and the order of formation of the Constitutional Court of Serbia, the author came to the conclusion that it included the best traditions of the European constitutional control theory.
