PROTEST POTENTIAL PEACEFUL MANIFESTATION: CONSTITUTIONAL FORMATS OF THE PAST-SOVIET REPUBLICS

In article on the basis of the analysis of the constitutions of the past-Soviet republics is characterized by variants of fastening to them of the freedom of Assembly with regard to their varieties, including manifestations, rallies, demonstrations, marches, picketing. It is concluded that in this group of countries freedom of peaceful demonstrations of joint or protest character is constitutionally introduced into certain borders, taking into account the interests of security of the individual, society and the state, as well as in line with the principle of inadmissibility of violation of the rights and freedoms of other persons in the implementation of their own. Restrictions on freedom of demonstration are expressed in procedural and subjective, but not meaningful forms. Therefore, it is possible to hold them in support of the public authorities, as well as in a protest key. The subjects of the exercise of freedom of demonstrations is defined as rule by the citizens.
