Abstract:
The article deals with one of the most urgent for the modern historical-legal science issues - preconditions for the emergence and functioning of the system of legal dualism in the Russian Empire. The prolonged existence of such a system is one of the most important features of the legal evolution of Russian society, which distinguishes it from the similar evolution of most other countries in the Romano-German legal family. The most important component of the legal dualism was customary law, which existed in the country prior to the first decades of the twentieth century, covering the main - peasant - part of the population, as in the ancient society, and to a lesser degree in the Moscow society - to a certain extent, and other social groups. The author argues, using legal sources of ancient Russia and the Moscow kingdom and based on the achievement of pre-revolutionary and modern legal historiography, that the design of the system of legal dualism in the Russian Empire did not have arbitrary power, was a natural result, based on the premise that emerged and grew in all the previous centuries of Russian stories. It argued the position that the final differentiation of custom and positive law at the Moscow State did not occur, custom and positive law reacted in a single legal space of society, and to a certain extent (as it shows an example of localism) state out of keeping with customary law and in respect of the nobility. Materials of this article can be used in training courses on the history of Russian state and law and may be interesting to teachers and students of legal specialties of higher education.
