THE INTERNATIONAL LABOR STANDARDS OF THE FREEDOM OF LABOR AND THE RIGHT TO LABOR IN THE CONSTITUTIONAL AND LEGAL PRACTICE OF RUSSIA

Being an integral part of intrastate economic mechanism, labor rights and freedoms of a person in Russia are oriented and in the higher degree correspond to the provisions of international and legal acts in the field of man’s labor activity. The peculiarity of economic and political system development with certain crisis manifests is caused by the problem on the correlation of the constitutional and legal and international and legal regulation mechanism of economic relations as the freedom of labor and the right to labor. While speaking about the correlation of intrastate and international and legal regulation of labor activity there is a significance of researching the character of intrastate legislature and authoritative international acts. The analysis of intrastate and international provisions may be conducted through the research of the international labor standards. At present the juridical community not only in Russia but abroad is interested in the problem of defining the international labor standards (Peter Bakvis und Molly McCoy). Materials and methods: The research base of the work is compiled from scientific views of jurists and normative legal sources analyzed through general and special methods of scientific cognition. Conclusions: The article represents the complex appreciation of the international labor standards, defines the constitutional provisions containing the labor rights and freedoms, analyses the correlation of the intrastate legislature and authoritative international acts in the labor sphere. Possibilities of further usage of the scientific work results: The special contribution of the author to the research of the subject matter is the revelation of the secured international standards in the International law and also their content allowing to analyze the provisions of the Russian Federation Constitution in the labor sphere with the object of their correlation to the international norms. Social consequences: The given analysis allows the members of a society to understand the essence of the international labor standard more precise that can be one of the conditions in realizing the constitutional rights and freedoms in the labor sphere more effective. Originality and importance: The results of the work can be useful for lawmakers in regulating the provisions on the freedom of labor and the right to labor in various spheres of a man’s life, for law scientists in conducting their researches, for law students in understanding the essence of the international labor standards and the constitutional provisions on the freedom of labor and the right to labor.
