Abstract:
The article analyses the priority of objects of criminal law protection under Russian law. Public danger of corruption offences, particularly bribery, is evaluated. The issues of punishment for bribery are criticized on the basis of statistical data. The authors suggest some criminal law ways on how to consider combating bribery that poses a threat to national security. A great number of papers of both Russian and foreign authors are dedicated to the issues of corruption. Among them are writings of B.V. Volzhenkin, I.P. Klepitsky, A.I. Kirpichnikov, N.F. Kuznetsova, P.S. Jani, Petrus van Duyne, Godfrey Harris, Leslie Holmes, George Moody-Stuart, Susan Rose-Ackerman, Bonnie J. Palifka, and of many others. In this article the problematic issues of law enforcement concerning liability for bribery are revealed based on a systematic approach and such specially-scientific methods as the statistical, formal logical and comparative law methods; the opportunities for creating mechanisms for prevention and suppression of corruption offences are studied. Conclusions are drawn concerning the importance of taking the political aspect of corruption into consideration and the need to combat malfeasance in terms of national security, as well as the inefficiency of multiple fines used as punishment for bribery. Given a shift in emphasis of harmfulness of high-level corruption towards fundamental state security interests, a new article in chapter 29 «Crimes Against the Fundamentals of the Constitutional System and State Security» is proposed.
