The causes and preconditions. Scientific literature has not studied this aspect of article 191.1 of the criminal code, as the size of illegally harvested timber. In connection with which there is a need to develop proposals to improve legislation in terms of establishing a theoretically reasonable and practically reasonable limits of the wood. Methods. The study was conducted using the following methods: through a comparative analysis with the quantities of large and very large size for other articles of Chapter 22 of the criminal code, with their degree of social danger, the analysis of practice of application of article 191.1 of the criminal code. Conclusions: 1. The value of the large size of illegal timber for the purposes of article 191.1 of the criminal code should be increased to 100000 rubles. 2. The value of especially large size, illegal timber for the purposes of article 191.1 of the criminal code should be increased to 1500000 rubles and attributed these acts are classified as serious. Practical application: using these values the size of the illegally harvested wood will allow for a more clear differentiation between the two formulations article 191.1 of the criminal code, to bring to heightened criminal liability really large and professional dealers on the market of «black forest», often associated with organized criminal activities, including transnational.
