CIVIL ASPECTS OF OPTIMIZATION OF CROSS-BORDER INHERITANCE BUSINESS

The article considers civil aspects of optimization of business inheritance, which is associated with various national legal systems, in order to determine the most effective solutions. Researched some conflict of laws issues applicable to the substantive law, given that each state operates its own international private law which determines the limits of application of foreign law, these issues are very important in the collision of the national legal orders having their own views on resolution of cross-border inheritance business. The study used special methods-theoretical legal science: formal-legal (dogmatic) method which was studied legal texts and legal facts, their interpretation in a logical sequence with the use of special legal terms and structures. The main finding of this article - inheritance in cross-border business, it needs to inherit as a single unit, despite the differences in legal systems of European countries, with the international conventions governing inheritance relationship must contain the recommendations, except in cases of business ownership in several countries to optimize inheritance, it is recommended to apply the procedure of estate planning. The necessity to legislate in the civil code the following capabilities: performing a binding of wills; the Commission of joint wills of spouses; the definition of the legal regime of hereditary property between the testator and which will take effect during his lifetime, the succession agreement; the extension of the rights of executors to the Trustees and the establishment of a perpetual trust management hereditary property; lifetime education by the testator of his property to a special Fund and continued functioning even after his death for once and for all established rules.
