DUAL-USE GOODS AS EXPORT CONTROL OBJECTS: LEGAL ISSUES IN THE RUSSIAN FEDERATION AND THE USA

Today, the Russian economy faces the task of diversifying the military-industrial complex by increasing the output of dual-purpose goods. High-tech products are supposed to make the half of the total volume of MIC production by 2030. However, there are some gaps in the current legislation, related to dual technologies regulation. Legal issues of dual-use goods and export control are considered in the foreign (M. Beck, B. Seyoum, A. Wetter, etc.) and Russian (Malkevich V. L., Pokrovsky K. K., Roskoshnaya M. S., Terekhin N. V., etc.) legal science. Using the method of analysis and the comparative legal method, the author reveals the content of the terms of dual-use goods and technologies, the legal status of the Wassenaar Arrangement international regime, the problem of the product identification procedure according to the control lists of dual-use goods and technologies. It is concluded that it is necessary to regulate the issues of transfer of dual-use products and technologies, introduce a legislative definition of dual-use technology, create a single list of controlled goods, and regulate the principle of ‘catch-all’ control in the current Russian legislation. The results of the analysis may be interesting for scientists, and may be useful for Russian and international companies that develop and export dual-use goods.
