ADMINISTRATIVE LIABILITY FOR COPYRIGHT VIOLATIONS

The author of the article studies the problem of imposition of administrative charges for copyright infringement. The purpose of the research is to identify specific features of administrative liability for copyright violations and analyse these features with the aim of enhancing practical efficiency of relevant legal mechanisms. The article is structured logically to cover the following key issues: legal regulation and protection of copyrights (with a view to determine the legal nature of copyrights and the correlation between the notions of «regulation of rights» and «protection of rights»); copyright infringement (with the focus on examining the disposition of elements of an offence stipulated in the section 1 of the article 7.12 of the Russian Administrative Offence Code); a «counterfeit» as a matter of copyright infringement (aiming to put forth proposals on improving the administrative law); and the practical issues related to imposition of administrative charges for copyright violations (including the competence of authorized government bodies (using the example of customs authorities) to initiate administrative cases against alleged infringers, proper determination of a matter of certain administrative offences and qualification of the counterfeit nature of artwork items with all circumstances considered). The author of the article has used argumentative, empirical, logical and normative methods of research. Examples of court rulings have been provided along with identified major legal and law-enforcement issues.
