PRINCIPLES OF INHERITANCE BY LAW IN THE REPUBLIC OF MOLDOVA

The article is devoted to the fundamental principles expressing the essence and conditionality of inheritance law, which determines the general direction of legal regulation - the principles of inheritance under the law of the Republic of Moldova. The relevance of this work is beyond doubt, the material of the article is based on the study and generalization of norms and theses of inheritance law. Objective: The purpose of writing this research paper is to identify and explain the specific nature of inheritance principles by law, as a legal category in the legislation of the Republic of Moldova. In the Russian legal doctrine the present work is devoted to the work of such authors as: B.A. Bulaevsky (Б.А. Булаевский), E. V. Valkova (Е. В. Валькова), E.A. Kirillovа (Е.А. Кириллова), A.M. Nemkov (А.М. Немков), N.S. Smolkov ( Н.С. Смольков) and others. Model: The methodological basis of this study was made by general scientific methods, such as: dialectical, structural-functional, formally logical, and also a special-legal method - legal-dogmatic. The main idea and meaning of inheritance according to the law, as a separate institution of inheritance law, consist in the possibility and guarantee of the transition of all benefits acquired and acquired during the life of the testator, to his relatives and surviving spouse. Conclusions: As a result of the research done, we came to the conclusion that the principles of inheritance according to the law reflect not only the laws of the whole hereditary law, but also represent special norms in the field of hereditary legal relations.
