THE CONCEPT OF THE LEGAL CATEGORY «PROPERTY OF THE EMPLOYEE», FOR DAMAGE WHICH OCCURS THE LIABILITY OF THE EMPLOYER

The purpose of the research is to consider one of the theoretical problems of legal regulation of compensation by the employer for damage caused to the property of an employee due to the lack of a legal concept of the category «property of an employee» used by the legislator in Art. 235 of the labor code. The need to study this category is due to its great importance for understanding the liability of the employer for damage to personal belongings of the employee. To achieve this goal the author aims: to analyze the scientific positions taken by various scientists-Trudoviks, the concept of property of the employee, for damage which arises the obligation of the employer for his compensation under the said article; to give a scientific assessment of these items, which will establish the degree of acceptability for the solution of the problem of determining the composition of the assets of an employee; to determine the composition of the property of the employee, for the bearing damage which occurs the liability of the employer; to justify the possibility of applying to this property the rules of Art. 235 of the labor code of the obligation of the employer to compensate for the damage caused to him; to make recommendations for the improvement of this norm, consisting in the development of the concept of the category «employee's property» missing in it, which will contribute to improving the level of protection of his labor rights. The need to solve these problems caused the need to use such methods of scientific knowledge as General scientific (analysis, synthesis, analogy, generalization, classification) and special legal (comparative legal, legal - technical, dogmatic). The scientific novelty of the article is that it is the first study specifically devoted to the clarification of the concept of the analyzed category. A special contribution to the study of the employer's liability for damage caused to personal belongings of the employee is formulated by the author the concept of category «employee property», which should be accepted by the legislator and enshrined in Art. 235 of the labor code. This article may be of interest to researchers, employers, legal advisers, human resources managers and other practitioners, and also does not exclude the possibility of its use in educational process by teachers, postgraduates, masters and students of law universities and faculties.
