Objective: The study is devoted to the protection of economic interests of the Russian Federation by criminal means, the article focuses on the problems of mistaken qualification of smuggling of cash, cash tools, alcohol products and tobacco products at the time of preparation for a crime, attempted crime and a completed crime. The goal of the work is to obtain objective data on the factors that influence the qualification of these crimes and the rationale for ways to improve the effectiveness of criminal legal measures to counter smuggling. Methodology: to prepare the article the author used the following methodological foundations: a set of general scientific and special methods of cognition of the social and legal reality. The methodological basis of the study is a comparative legal method with the inherent requirements of objectivity, comprehensiveness, historicism, and concreteness of truth. Conclusions: the study revealed contradictions in the qualification of smuggling at the stages of preparation, assassination and the completed crime; specific recommendations have been developed to eliminate the identified contradictions and problems. On the basis of the results obtained, it is possible to improve criminal legislation, improve the activity of law enforcement agencies in the qualification of crimes in the customs sphere. Value: Article can be useful to a wide range of specialists involved in countering smuggling. It can be used by scientists, teachers, students, graduate students and other categories of students, specialists of customs and other executive authorities in the member states of the EAEC.
