Abstract:
The article discusses the effect of the ban «circumvention of the law» in Russian civil law, as well as the consolidation of the design of «circumvention of the law» in German law. Some features inherent in the construction of «circumvention of the law» are considered. The conclusions are formulated taking into account the legal specifics of this phenomenon, based on the analysis of German and Russian civil legislation.
