COMPARATIVE LEGAL ANALYSES OF GENERAL PROVISIONS ON PUBLIC-PRIVATE PARTNERSHIP IN RUSSIA AND CHINA

Public-private partnership (PPP) is a developing institution, which is regulated and effectively used in many countries’ national legal systems. Both Russia and China actively promote legal regulation in sphere of PPP. On January 1, 2016 came into force special law on PPP in Russia. China also adopted Administration method for concession in infrastructure and public works in 2015, which regulates concession agreement that is considered as a form of PPP. In addition, in 2017 a special law on PPP was submitted for nationwide discussion in China. This gives a material for legal comparative investigation of all abovementioned legal acts. Moreover, there are only few works on PPP in China, despite the fact that China is the leader amongst the BRICS countries in the amount of PPP projects. This article analyses abovementioned legal acts of both countries, makes comparative study of general provisions on PPP. In whole, legal definition of PPP in both countries is similar; however, there are some crucial differences, as for example in subjects of PPP contracts.
