SPECIFICS OF THE CONSTITUTIONAL COURT JUDGES STATUS: THE EXPERIENCE OF THE REPUBLIC OF SERBIA

The article presents analysis of the legal status of the judges of the Constitutional Court of Serbia. The Constitutional Court of Serbia is autonomous and independent state body exercising protection of constitutionality and legality. The independence of the Constitutional Court is guaranteed inter alia by the special procedure of elections and dismissal of constitutional judges. A Judge of the Constitutional Court enjoys the same immunity as a Member of Parliament. The decision on the immunity of the judges of the Constitutional Court is taken by the Constitutional Court. A Judge of the Constitutional Court may not engage in another public function or professional activity. Exploring the contents of status of a judge of the Constitutional Court of Serbia the author comes to the conclusion that his status differ from the status of a judge of courts of general and special jurisdiction that can be explained by the special position of the Constitutional Court in the system of separation of powers.
