RECEPTION COMPUTER INFORMATION AS A NEW CATEGORY OF OPERATIONAL-SEARCH LEGISLATION

The task: the addition in 2016 of the list of investigative measures, a new event «getting computer information» was the subject of numerous discussions about the necessity of the legislative definition of each of the operational-search activities. Methodology: formal legal and comparative legal methods were used. Conclusions: The author, on the basis of the analysis of legal bases and various approaches to definition of essence of operational search action «reception of the computer information», made attempt to present the contents of the called action. Framework research/a possibility of the subsequent use of results of scientific work: certain provisions of the work, revealing the content of the operational search activity «obtaining computer information» can be used in scientific research. Practical value: the proposals formulated by the author, can be used by the agents of the detective-search activity with the publication of normative acts determining the procedure of carrying out of operatively-search actions. Social consequences: the article is of interest for further improvement of the operational and investigative legislation. Originality/value: The article is intended for employees of operational search units, scientists, specialists and a wide range of readers interested in the problems of operational search activity.
