Abstract:
The article analyzes the evolution of the customary law, an integral part of the Russian system of legal dualism, in the second half of the XIX century, when as a result of the reforms of Alexander II Russian society has entered a qualitatively new stage in its historical evolution - stage of industrial modernization. The agrarian and judicial reforms have led to significant changes in the legal status of the peasantry, which has highlighted the problem of adaptation of legal relations among the peasants, who continued to be based on customary law, to the new conditions created by the sudden acceleration of social and economic transformations in Russian society. Government, conscious of the danger and the practical impossibility as fast translation freed from serfs rights within the scope of positive law, would prefer palliative saving path took shape during the period of the empire of legal dualism system, which found its expression in the content of the agrarian and judicial reform, activities parish courts. In the article argued the author's position, based on the analysis of the legal sources of the time and using works by Russian lawyers, according to which the preservation of customary law in the post-reform era has played a dual role: a relatively positive in the 1860-1870-ies and relatively negative in the 1880-1890-ies. Materials of this article can be used in training courses on the history of Russian state and law and may be interesting to teachers and students of legal specialties of higher education.
