THE SUBJECT OF A CORRUPTION CRIMES IN A COMMERCIAL ORGANIZATIONS

Abstract:
The purpose of this study is to assess the signs of the subject of corruption crimes committed in commercial organizations. Methodology. The study was conducted using the methods of comparative law, the results were formulated on the basis of a formal legal methodology. Сonclusions. In relation to corruption crimes committed in commercial organizations should be divided into two groups of subjects of crime: a) a special subject (a person performing managerial functions in a commercial or other organization, as well as in a non-profit organization that is not a state body, local government, state or municipal institution) is characteristic of the crimes under art. 201 of the Criminal Code, hh. 5-8 Art. 204 of the Criminal Code, Art. 204.2 of the Criminal Code (in the case of the transfer of commercial bribery). b) the general subject of the crime is characteristic of chh.1-4 art. 204 of the Criminal Code, Art. 204.2 of the Criminal Code of the Russian Federation (in the case of commercial bribery), intermediation of commercial bribery (Article 204.2 of the Criminal Code of the Russian Federation) Practical meaning. The article will be of interest to researchers, practicing lawyers, representatives of the business community, teachers, students and graduate students, as well as all who are not indifferent to the issues of combating corruption.
