Abstract:
Task: The protection of participants in the Russian criminal process is an important part of the process of proving and achieving its goal. In addition to the actual criminal procedural measures of protection, it is possible to apply extra-procedural measures, which are provided for by Federal Law № 119-FZ of August 20, 2004 «On State Protection of Victims, Witnesses and Other Participants in Criminal Proceedings». This law establishes a list of security measures involving the use of specific prerequisites, which include grounds and grounds. In this regard, a special task is the elimination of legal contradictions aimed at improving the reasons for the application of state protection measures to persons who contribute to justice. Methodology: During the research, the author used various methods: induction, deduction, generalization, abstraction, prediction, modeling, functional-structural analysis, and systematic and logical methods. Conclusions: In the course of the study, the following conclusions were drawn: 1. It is recommended to exclude the need to obtain the consent of guardianship and trusteeship bodies for the application of security measures in the absence of a written application of a minor protected person. 2. It is proposed to supplement the title of article 16 with the following wording: «Reasons and basis for the application of security measures». Taking into account the fact that the reasons are primary, and the basis - secondary, change the order of the parts of Art. 16: Part 2 of Art. 16 to move to part 1, and part 1 - to part 2. Thus, in part 1 the reasons will be listed, and in part 2 - the ground. 3. It is expedient to formulate the content of Part 2 of Art. 16 of the current Law of August 20, 2004 № 119-FZ as follows: «In the absence of a written application of the protected person (close relatives, relatives or close persons), as well as against minors - parents, persons substituting for them .... The official of the competent authority has the right to personally decide on the application of security measures subject to the consent of the protected person». The possibility of subsequent use: The obtained results can be used to improve the legislation of the Russian Federation with regard to the application of security measures provided for in Federal Law № 119-FZ of August 20, 2004 (as amended on 07.02.2017) «On State Protection of Victims, Witnesses and Other Participants in Criminal Proceedings»; continuation of scientific research in the field of ensuring the safety of protected persons in a criminal case. The practical significance of the results obtained is expressed in the possibility of using them in forensic investigation. Social significance: The results obtained are aimed at optimizing the legislative regulation of the application of personal security measures in relation to persons participating in criminal proceedings. The value of the results obtained is due to the presence in it of posing a problem that is essential for improving the level of protection of victims, witnesses and other persons assisting justice.
