REMAINING CONTROVERSIAL PROVISIONS OF THE RUSSIAN LEGISLATION IN THE SPHERE OF GARDENING AND TRUCK FARMING BY CITIZENS FOR THEIR OWN NEEDS

Objective: the article intends to consider topical issues related to the conduct of non-commercial activities by Russian citizens in the form of gardening and truck farming, in particular, to consider the latest changes that have occurred in the Russian legislation regulating the relevant sphere of land and other related legal relations, with their inherent advantages and disadvantages. Methodology: the article provides legal analysis of the provisions of the Federal law of July 29, 2017 № 217-FZ «On the conduct of gardening and truck farming by citizens for their own needs and on amendments to certain legislative acts of the Russian Federation», which enters into legal force from January 01, 2019; comparison of its norms with the current legal order regulating the conduct of activities by citizens in the form of gardening and truck farming in the Russian Federation is also provided. Conclusions: the article points to some significant results of the introduction of new rules into the legislation - the narrowing of forms of activity in the field of gardening and truck farming; transformation of the structure and competence of managing bodies in organizations in the field of gardening and truck farming; change of the legal status of members of such organizations and change of the conditions of their membership; change of the realization model of gardeners and truck farmers’ right to erect real estate and determine its purpose category, etc. At the same time, the article’s comparative legal analysis is accompanied by the identification of shortcomings and controversial issues in the legal norms, the beginning of which is yet to be implemented. Practical value: the article, on the one hand, provides a rationale for the introduction of new legislative provisions since 2019, but, on the other hand, it draws the attention of the legislator to the problems and possible risks associated with the innovations, adopted and soon coming into force, for their further elimination. Originality: the article intends to familiarize with the legal basics and current trends in the development of legislation on the conduct of gardening and truck farming, as interested persons related to such activities, scientists studying the issues of certain types of land use, as practitioners providing legal advice in this area.
