Abstract:

The article is devoted to the problem of determining the size (area) of the land plot to be redeemed by the owner of the property located on it. The subject of the analysis was the legislation governing the legal relationship for the acquisition of land in state or municipal ownership, the owner of the building located on it, facilities and judicial practice in disputes arising in connection with the refusal to purchase the land. It is concluded that the requirement, according to which the justification of the area of the purchased land plot is necessary, is developed exclusively by law enforcement practice and is not consistent with the provisions of the current legislation on the provision of land. Proposals aimed at ensuring the legal regulation of the legal relations under study are made.
