Abstract:
Aim. The aim of the research is to make the analysis of the legal status of the aboriginal population of Australia. The research has been carried out based on the effective national legislation of Australia, which regulates the legal status of indigenous peoples of this continent. The article emphasizes the crucial issues of maintaining and developing of indigenous peoples of Australia. Methodology. To achieve the aim of the research general scientific methodological approach that allows to determine the scope of the study, to clarify the main provisions of the national law in Australia regulating the legal status of the indigenous peoples in the country, to identify key conceptual aspects of the research topic, has been applied. The study used scientific methods of cognition, such as analysis and synthesis, generalization. Results. The legal status of indigenous peoples includes following aspects: citizenship issues, issues of non-discrimination on grounds of race, colour, birth, national or ethnic origin; land rights of indigenous Australians; Aboriginal rights to the preservation and protection of the places, areas and facilities of special significance; the right to a traditional way of life; the right to education and others. The practical significance. The findings of the research may be useful for the purpose of teaching special courses at the law faculties of universities, such as “International protection of human rights”, “International protection of the rights of minorities and indigenous peoples” as well as in the activities of state bodies, public organizations and individuals, involved in indigenous peoples’ protection process generally. Value. The results can be applied in the activities of relevant Russian government agencies, including the Ministry of Education, Culture, Natural Resources and Environment; as well as for the elaboration and implementation of strategies of the Far East’ development and of the economic growth of Russian Federation generally.
