Abstract:
In modern conditions there is a difficult situation in the sphere of legal regulation of subsoil use. The ambiguity of the qualification of injury from the use of mineral resources, application of norms of international and Russian legislation, identified the need to review and update industry and Federal legal framework. Environmental crime, in particular crimes under article 255 "Violation of rules of protection and use of mineral resources" have a special place in the system of regulation of mining and prevention of damage in the design fields. At this stage low number of criminal cases initiated in this article indicates a lack of attention to the issue and the lack of clarity in the qualifying signs of criminal acts.
