Abstract:
Aim. As The aim of the research is to make the analysis of conventional and customary law and the principles of international law to determine the mechanism of international responsibility of States for the adverse effects of climate change leading to flooding of the state territory. Methodology. The following methods were used in the research: analysis and synthesis, generalization, dialectical, system-structural methods, formal-legal, legal-technical method. Results. At the moment there is only the formation of international legal mechanisms of responsibility for adverse effects of climate change entailing immersing of the national territory due to several gaps in international law on the subject. As climate change begins to be seen as a threat to peace and security, it allows us to speak about the possibility of the application of other mechanisms than the system of the UNFCCC. The practical significance. Results of the study may be used by the "disappearing" states for the application of responsibility for the immersion of their territory.
