Abstract:
This article discusses some aspects of the influence of the teachings of Plato and Aristotle to the modern theory of constitutional law. Special attention is paid to questions of formation in the teachings of Plato and Aristotle the idea of enshrining the optimal state and society. Substantiates the thesis that Plato was one of the first representatives of positivism. According to Plato is doomed to degradation of any phenomenon (including law), as every embodied form is not able to convey the eternal type, that is, Eidos. Aristotle, criticizing certain provisions of the philosophy of his teacher, successfully combined the ideas of Plato's positive law and natural law.
